Your Rights — Regardless of Immigration Status
- 无论移民身份,所有工人享有完整的工资与工时保护。 All workers have full wage-and-hour protections regardless of immigration status. §1171.5
- 劳工专员不会询问、也不会举报你的移民身份。 The Labor Commissioner does not ask about — and does not report — immigration status.
- 可以匿名投诉,无需任何证件。 Complaints can be filed anonymously — no ID required.
- 投诉后 90 天内遭报复,法律推定雇主有罪;罚款最高每名员工 $10,000。 Retaliation within 90 days of a complaint = employer presumed guilty; up to $10,000 per employee. SB 497
- 以举报移民身份相威胁,是刑事犯罪。 Threatening to report your immigration status is a criminal offense. §1019
💡 现金发薪不影响你的任何权利 — 最低工资、加班费、休息、病假全部一样适用。
Being paid in cash changes nothing — minimum wage, overtime, breaks, and sick leave all still apply.

If You Think You're Underpaid — what to do
- 记录一切 — 工资单、排班表、工时。你自己的记录在加州也算证据。 Document everything — pay stubs, schedules, hours. Your own records count as evidence under CA law.
- 拨打 833-526-4636(免费、多语言)说明情况。 Call 833-526-4636 (free, multilingual) and explain your situation.
- 欠薪是违法的 — 雇主须补发工资,并支付罚款。 Wage theft is illegal — the employer pays back wages plus penalties.
- 工资追讨时效为 3 年 — 过去 3 年的差额都可以追讨,越早开始越好。 There's a 3-year window to file — you can recover up to 3 years of back wages. Sooner is better.
